SPREQ general terms and conditions

Version 1.0, valid from 14 August 2026.

These terms apply to personal use of SPREQ. If you use SPREQ for your business, the Business terms and conditions also apply.

This English text is a translation provided for your convenience. The Dutch version is the legally binding one.

1. Who we are

SPREQ is offered by Netron ICT, established at Virulyweg 43 B, 7602 RG Almelo, registered with the Chamber of Commerce (KVK) under number 93536399.

We communicate in Dutch and English.

2. Definitions

3. The agreement

3.1 The agreement is formed as soon as you create an account and accept these terms.

3.2 You must be at least 16 years old to use SPREQ. If you are younger, you may not create an account.

3.3 You may only use SPREQ if you have the legal capacity to act and are able to comply with the terms.

3.4 We may refuse an application without giving a reason.

4. What SPREQ is and is not

4.1 SPREQ is a messaging service. Your messages and conversations are end-to-end encrypted. We cannot read or listen in on their contents.

4.2 SPREQ is not a telephone service. You cannot use SPREQ to reach 112 or other emergency numbers. Always make sure you have an ordinary telephone connection available.

4.3 SPREQ is not a storage service and not a backup service. See article 6.

4.4 We make every effort to keep the service available, but we give no guarantee of uninterrupted availability. Maintenance, outages at third parties, network problems and limitations of your device may make the service temporarily unusable.

4.5 We may change the service, add features and remove features. In the case of a change that is clearly to your disadvantage, we will inform you at least 30 days in advance, and you may cancel your paid subscription as of that date free of charge, with a refund of the unused portion.

5. Your account and profiles

5.1 You are responsible for access to your device and your account. Use a screen lock.

5.2 You may have several profiles under a single account. Profiles are kept separate from one another in the app. Technically, however, they belong to the same account. We can therefore see that profiles belong to the same account. See the privacy statement.

5.3 You may not share, sell or transfer your account.

5.4 You may not use a false identity to pass yourself off as someone else or as a business you are not authorised to represent.

6. Messages, files and the 72-hour rule

This article is important. Read it carefully.

6.1 SPREQ does not store any chat history on the server. Your conversations exist only on your own devices and those of the people you are talking to.

6.2 A message or file that has not yet been delivered is held encrypted on our server. As soon as it has been delivered, we delete the server copy.

6.3 As soon as a message or file has been collected, we delete the server copy immediately. If it has still not been collected after 72 hours, we delete it permanently. There is no automatic retry. You can resend it manually yourself.

6.4 We do not make a backup of your messages or files. If you lose your device, wipe the app or your device breaks, your conversation history is gone for good. We cannot restore it. This is a deliberate design choice and part of what you are getting from us.

6.5 The temporary storage per profile is:

6.6 If your temporary storage is full, you cannot send a new file until space becomes free. Space becomes free as soon as a file has been collected or has been deleted after 72 hours.

6.7 You are responsible for what you send and for the consequences of doing so.

7. Voice and video calls

7.1 Voice and video calls are available from the Plus subscription onwards.

7.2 Calls run directly between devices where possible. Where that is not possible, the traffic runs encrypted via our relay server.

7.3 We do not record calls and cannot listen in.

7.4 Quality depends on your internet connection. We cannot give any guarantee on that.

8. Subscriptions and prices

8.1 All prices are per year and include VAT.

8.2 Chatting is always free. You do not need a paid subscription for text messages, photos and documents.

8.3 You buy paid subscriptions in the app via the App Store or Google Play. The terms and payment policies of Apple or Google also apply to those.

8.4 A paid subscription renews automatically for a further year each time, unless you cancel. After the first renewal you can cancel at any time, with a notice period of no more than one month.

8.5 You cancel in the subscription settings of the App Store or Google Play, or via support@spreq.nl. Cancelling is just as easy as signing up.

8.6 We may adjust prices. A price increase only takes effect at the next renewal and we notify you at least 30 days in advance. If you do not agree, you can cancel before the renewal date.

8.7 If you cancel, you keep access until the end of the paid period. After that the profile reverts to Free or lapses, depending on the profile type.

9. Right of withdrawal

9.1 As a consumer, you normally have a 14-day cooling-off period after taking out a paid subscription.

9.2 When you sign up, we expressly ask you to allow us to begin delivery immediately. If you agree to this and thereby declare that you waive your right of withdrawal, your cooling-off period lapses as soon as delivery begins. This is set out in article 6:230p of the Dutch Civil Code.

9.3 If you do wish to make use of your cooling-off period, you can cancel within 14 days via support@spreq.nl or using the model form at the bottom of these terms. We refund within 14 days using the same payment method.

9.4 If you paid via the App Store or Google Play, in practice the refund is handled by that party. We will help you with this.

10. House rules

10.1 You comply with SPREQ's House rules. These form part of these terms.

10.2 In brief, the following are prohibited: criminal content, child abuse material, terrorism, trade in drugs or weapons, fraud and scams, spam, phishing, stalking, threats, incitement to hatred, and infringement of the rights of others.

10.3 Also prohibited: automated bulk sending, misuse of the business search function, attempts to circumvent our security, and offering the service to third parties without our permission.

11. Moderation, reports and measures

11.1 We do not read your messages and do not scan the content of your conversations. Technically, we cannot do so either.

11.2 We take action in response to reports, to information that is visible outside encrypted conversations (such as profile names, profile photos, company details and publicly searchable information), and to orders from competent authorities.

11.3 Anyone can report illegal content or abuse via the report button in the app or via abuse@spreq.nl. How this works is set out in the document Reporting illegal content and abuse.

11.4 If we take action, we can:

11.5 We choose the measure that fits the seriousness of the breach. When we take a measure, we let you know what we have done, why, on which facts we base it, whether automated means were used, and how you can object. This follows from article 17 of the Digital Services Act.

11.6 You can object within 6 months via abuse@spreq.nl. We assess your objection through a member of staff and not solely by automated means.

11.7 Where there is a serious suspicion of a criminal offence in which the life or safety of persons is at risk, we report this to the competent authorities. This follows from article 18 of the Digital Services Act.

12. Advertisements

12.1 On Free profiles we show advertisements as a single, unobtrusive card among the chats, which is always visible.

12.2 We show advertisements as a single, unobtrusive card among the chats, never within a conversation, never full-screen, never at the top of the chat list, and without auto-starting video, sound or pop-ups. Advertisements cannot be dismissed; with the Free plan they are part of the deal.

12.3 Advertisements are chosen at random and are not tailored to the individual. We never use the content of your conversations, your contacts, your files, your location or your behaviour for advertisements. Everything is hosted by SPREQ itself and there is no ad network. We only measure anonymised totals per advertisement (impressions, clicks and click-through rate) and share these with the advertiser, without personal data.

12.4 Paid profiles are ad-free.

12.5 The details are set out in the Advertising policy.

13. Security and encryption

13.1 Messages, files and conversations are end-to-end encrypted. The keys are held on the participants' devices.

13.2 We do not have a master key and cannot decrypt encrypted content.

13.3 We do not build in a backdoor and will not do so voluntarily either.

13.4 If you find a vulnerability, please report it via security@spreq.nl. We operate a coordinated vulnerability disclosure policy and will not report you as long as you act carefully and do not view, alter or share other people's data.

14. Intellectual property

14.1 SPREQ, the logo, the app and the website belong to us or to our licensors. You receive a personal, non-transferable right of use for as long as the agreement is in force.

14.2 You may not decompile, modify or imitate the app, except to the extent that the law mandatorily permits.

14.3 What you send remains yours. We claim no rights to your messages or files and do not use them for our own purposes.

15. Liability

15.1 We are not liable for damage arising from:

15.2 For the rest, our liability is limited to the amount you have paid us in the 12 months preceding the damage, with a minimum of € 50.

15.3 These limitations do not apply in the event of intent or deliberate recklessness on our part, and not to the extent that the law does not permit them. Your statutory rights as a consumer always continue to apply.

16. Termination

16.1 You can delete your account in the app at any time. We then delete your account data in accordance with the retention periods in the privacy statement.

16.2 We may terminate the agreement in the event of a serious or repeated breach of these terms or the House rules, in the event of abuse, or where we are legally required to do so.

16.3 If we terminate a paid subscription without any breach on your part, we refund the unused portion on a pro rata basis.

16.4 After termination, your local conversation history remains on your device until you remove the app. We do not have a copy of it.

17. Changes to these terms

17.1 We may change these terms. In the case of substantive changes, we inform you at least 30 days in advance in the app or by email.

17.2 If you do not agree with a change, you can cancel the agreement before the effective date. In the case of a paid subscription, we refund the unused portion on a pro rata basis.

18. Complaints and disputes

18.1 You can submit complaints via support@spreq.nl. We respond substantively within 14 days.

18.2 Dutch law applies to this agreement.

18.3 We submit disputes to the competent court in the Netherlands. As a consumer, you may also bring the dispute before the court of your place of residence.

19. Accessibility

We aim for the app and the website to meet WCAG 2.1 level AA. How we do this, and where we do not yet comply, is set out in our Accessibility statement.
